Die Musik des kanadischen Komponisten Oskar Morawetz ist noch nicht gemeinfrei; die Orchesterbegleitung habe ich im Auftrage der kanadischen Sopranistin Kira Braun-Diamantakos geschaffen, die seit ihrer Kindheit mit der Tochter des Komponisten befreundet ist, diesen auch persönlich kannte und eine Sondergenehmigung innehat, das Werk aufzuführen. Heute, am 23. August 2021 erreicht mich eine Nachricht, dass Claudia Morawetz mir gerne erlaubt, die virtuelle Orchesterbegleitung für Studien- und Probenzwecke zu veröffentlichen und anzubieten. Soll sie bei Konzerten verwendet werden, muss die entsprechende Lizenz beim »estate« erworben werden. Ob damit die »Erbin«, der »Verlag« oder beides gemeint ist, werde ich zu eruieren haben. Der bis heute herrschende absurde status quo, dass mit dem Gesang meiner Auftraggeberin auch meine Orchesterklänge legal waren, ohne sie jedoch nicht, scheint überwunden. Im Video ist das Werk zwar in voller Länge zu hören, allerdings weder rein instrumental, noch von einer leibhaftigen Sängerin vorgetragen, sondern dergestalt, dass es sich nicht nur bei den Orchesterinstrumenten, sondern auch beim Sopran um Samples der Vienna Symphonic Library (VSL) handelt. Da man mit den Vokalsamples der VSL nur textlose Vokalisen präsentieren kann, stellt das Video keine vollgültige Aufführung dar, so dass die Urheber- und Aufführungsrechte m.E. nicht verletzt werden. In der Frage, ob und und welchen Konditionen genau es mir erlaubt sein wird, dieses Werk als reines Playback (also mit stummgeschalteter Vokalise) zu publizieren, bin ich also einen entscheidenden Schritt weitergekommen. Zu klären bleibt, wo und wie die Aufführungsrechte erworben werden können.

The music of the Canadian composer Oskar Morawetz is not yet in the public domain; I have created the orchestral accompaniment on behalf of the Canadian Kira Braun Diamantakos, who has been a friend of the composer's daughter since childhood, knew him personally and has special permission to perform the work. My negotiations with the aim of also legalizing the result of my participation as a one-man orchestra were pending untiel today, 23.08.2021. Kira told me the following: »Claudia did give her permission for you to post your Orchestral Accompaniment of “From the Diary of Anne Frank” on your website!« and later, in addition: »She was really fine with it, as long as it is for rehearsal purposes! I got the feeling she might not want it used as a performance accompaniment, unless those performers had paid a licensing fee to the estate. Does that make sense? Maybe that can be a disclaimer when you finally post it.« So this is the end of the sofar absurd status quo stating that with the singing of one soprano on earth my orchestral sounds are legal, without they are not. In this video the work can be heard in full length, but neither purely instrumental, nor performed by a real singer, but in such a way that not only the orchestral instruments, but also the soprano are samples from the Vienna Symphonic Library (VSL). Since VSL vocal samples can only be used to present textless vocalises, the video does not represent a fully valid performance, so actually copyright and performance rights are not infringed. Whether and under what conditions I will be allowed to offer this work as a pure playback (i.e., with the vocalise muted) is currently still up in the air. I hope to be able to legalize it in such a way that it may be made available without further ado not just for study purposes only and that I'll be able to tell you, where and how to pay for the license needed for a public performance and/or recording. One will see. I'll keep you up-to-date.
